The investigation conducted by the Madison County District Attorney’s Office into the injuries sustained by a football player from Deshler High School has reached its conclusion. The DA’s office characterized the incident as a “freak accident” and announced that no criminal charges will be pursued, as reported by WAAY 31. This update was shared during a press conference held on Wednesday.
The DA’s office clarified that the events leading to the injuries involved standard interactions typical of high school sports, with minimal physical contact observed. They found no indications of malicious intent or reckless behavior contributing to the incident. On August 19, August Borden, the injured player, suffered a serious skull fracture and a concussion, which necessitated hospitalization. His parents had previously disputed assertions made by school officials, who claimed that his injuries resulted from a fall. They emphasized that August is unable to remember the circumstances surrounding the incident due to the severity of his condition.
Initially, the investigation was transferred from Colbert County to Madison County to avoid any potential conflicts of interest, as Deshler High School is situated within Colbert County. Prior to this conclusion, officials had indicated that if charges were to be filed, they would be processed through the juvenile probation office in Franklin County and the District Court in Lawrence County. However, with the decision not to pursue any criminal charges, this scenario is no longer applicable.
